END USER LICENSE AGREEMENT (EULA)
1. Acknowledgment This agreement is between you (the "User") and the Developer of SiteBrief, and not with Apple, Inc. ("Apple"). The Developer is solely responsible for the SiteBrief application and its content.
2. Scope of License The license granted to you for SiteBrief is a non-transferable license to use the application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
3. Maintenance and Support The Developer is solely responsible for providing any maintenance and support services with respect to SiteBrief. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services for the application.
4. Warranty & Australian Consumer Law SiteBrief is provided "as is." While the Developer disclaims all warranties to the maximum extent permitted by law, nothing in this agreement excludes, restricts, or modifies any consumer guarantee or right under the Australian Consumer Law (ACL). In the event of any failure of SiteBrief to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application.
5. Professional Responsibility Disclaimer SiteBrief is a productivity tool for site inspections and does not provide professional engineering, architectural, or construction advice. The User is solely responsible for the accuracy and verification of all reports, markers, and data generated. Use of this app does not replace the need for professional judgment and on-site verification.
6. Product Claims The Developer, not Apple, is responsible for addressing any claims of the User or any third party relating to the application or the User's possession and/or use of that application, including: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
7. Intellectual Property Rights In the event of any third-party claim that the application or your possession and use of the application infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
8. User Data, Privacy, and Local Backups SiteBrief operates on a "local-first" model. All project data, photos, and PDFs are stored locally on your device. The Developer does not collect or transmit your data to external servers. You are solely responsible for backing up your device. The Developer is not liable for data loss resulting from device failure, hardware damage, or app deletion.
9. Subscription Terms (2026 Disclosure)Â Subscribing to SiteBrief premium features grants access to advanced reporting tools. Payment is charged to your Apple Account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store Account Settings.
10. Legal Compliance You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
11. Governing Law This agreement is governed by the laws of Queensland, Australia. Any disputes shall be resolved in the courts of Queensland.
12. Third-Party Beneficiary You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against you as a third-party beneficiary thereof.

13. User Content Responsibility You retain ownership of all content you upload, including text, photos, and PDF markup. However, you represent and warrant that you own or have obtained all necessary licenses, permissions, and rights to use, reproduce, and share such content. You agree that you will not upload any content that infringes upon the intellectual property rights, privacy rights, or other rights of any third party.
14. Indemnification You agree to indemnify, defend, and hold harmless the Developer of SiteBrief from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in any way connected with: (i) your violation of these Terms; or (ii) any claim that the content you uploaded infringes or violates the intellectual property or other rights of a third party.
15. Prohibited Conduct You are strictly prohibited from using SiteBrief to create, store, or share content that is unlawful, defamatory, infringing, or violates any third-party intellectual property. The Developer reserves the right to remove any content that it becomes aware of that violates these terms.
16. Changes to Terms We reserve the right to modify these Terms and Conditions at any time. We will notify you of any material changes by updating the "Last Updated" date at the beginning of these Terms or by providing an in-app notice. Your continued use of SiteBrief after such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the application.
