END USER LICENSE AGREEMENT (EULA)

1. Acknowledgment

This agreement is between you (the "User") and the Developer of Zafari, and not with Apple, Inc. ("Apple"). The Developer is solely responsible for the Zafari application and its content.

2. Scope of License

The license granted to you for Zafari is a non-transferable, non-exclusive, revocable, limited license to use the application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

3. Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services with respect to Zafari. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services for the application.

4. Warranty & Australian Consumer Law

Zafari is provided "as is." While the Developer disclaims all warranties to the maximum extent permitted by law, nothing in this agreement excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (ACL) or any other applicable legislation that cannot be lawfully excluded. In the event of any failure of Zafari to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application.

5. Artificial Intelligence Content & Accuracy Disclaimer

You acknowledge and agree that the text, images, species descriptions, classifications, and general information contained within Zafari have been generated, curated, or assisted by artificial intelligence (AI) technologies. Due to the nature of AI generation, the content may occasionally contain errors, inaccuracies, outdated information, or incomplete descriptions regarding animal species, behaviors, habitats, or safety guidelines.

Zafari is designed and intended to be used strictly as a general educational guide. You must not rely upon the information in this application for critical decision-making, including but not limited to medical treatment for animal bites or stings, handling hazardous or venomous wildlife, identification for consumption, or professional scientific research. Always verify critical information with certified local authorities, professional wildlife experts, or peer-reviewed scientific literature.

6. User Conduct and Wildlife Safety

When interacting with wildlife or utilizing Zafari in the field, you assume all risks associated with your actions. The Developer does not endorse or encourage approaching, handling, or disturbing wild animals. You are solely responsible for complying with all local, state, and federal laws and regulations regarding wildlife conservation and safety.

7. Product Claims

The Developer, not Apple, is responsible for addressing any claims of the User or any third party relating to the application or the User's possession and/or use of that application, including: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

8. Intellectual Property Rights & Third-Party Claims

In the event of any third-party claim that the application or your possession and use of the application infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim. The Developer retains all right, title, and interest in and to Zafari, including all source code, design architecture, graphics, and underlying software.

9. User Data and Privacy

Zafari respects your privacy and operates in accordance with applicable data protection standards. You are solely responsible for managing your device security and data backups.

10. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Governing Law and Jurisdiction

This agreement is governed by the laws of Queensland, Australia, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to this agreement shall be brought exclusively in the courts located in Queensland, Australia, and you consent to the personal jurisdiction of such courts.

12. Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against you as a third-party beneficiary thereof.

13. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Developer from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees and costs) arising out of or in any way connected with: (i) your violation of these Terms; (ii) your misuse of Zafari or reliance on its AI-generated content; or (iii) your violation of any third-party right, including intellectual property or privacy rights, or any wildlife conservation laws.

14. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify you of any material changes by updating the "Last Updated" date at the top of these Terms or by providing an in-app notice. Your continued use of Zafari after such changes constitutes your acceptance of the modified Terms.
